WHO DOES THE LAW APPLY TO?
- Any pools and spas that are open to the public generally (whether for a fee or free of charge); open exclusively to members of an organization and their guests, residents of an apartment building; or operated by the federal government.
WHAT DOES THE LAW STATE?
- Every public pool and spa must be equipped with an Anti-Entrapment drain cover that conforms to the entrapment protection standards of the ASME/ANSI A112.19.8 performance standard.
- Every public pool and spa with a single main drain (other than an un-blockable drain) must also be equipped with a device or system designed to prevent entrapment, such as a safety vacuum release system.
- Every pool or spa drain cover manufactured, distributed or entered in the stream of commerce in the United States must conform to the entrapment protection standards of the ASME/ANSI A112.19.8 performance standards.
WHEN DOES THE LAW COME INTO EFFECT?
- The law is effective one year after the date of enactment, each public pool and spa must be equipped with anti-entrapment drain covers.
- December 19, 2008 is one year after the date of enactment.
WHERE CAN I FIND SOMEONE TO INSTALL THE DRAIN COVERS?
- American Leak Detection has all of the necessary equipment and personnel (Certified Divers and diving equipment) necessary to complete the drain cover installation.
WHY WAS THE LAW PUT INTO PLACE?
- The purpose of the Virginia Graeme Baker Pool and Safety Act is to increase the safety of swimming pools and spas by:
- Requiring the use of proper devices, such as anti-entrapment drain covers and fences/barriers, through the establishment of a grant incentive program in order to encourage states to enact comprehensive pool and spa laws;
- Educating the public about drowning prevention;
- Establishing a federal swimming pool ans spa drain cover standard; and
- Ensuring public pools are equipped with proper safety devices.

The new law requires all public pools to have an Anti-Vortex or Anti-Entrapment drain cover to prevent a tragedy, such as Graeme Baker's, from ever happening again. Graeme Baker, grand-daughter of former US Secretary James Baker III, died as a result of a pwoerful spa drain sucking her down and entrapping her underwater. Her preventable death led to federal legislation passed in 2007 that requires all public pools to install and maintain Anti-Vortex / Anti-Entrapment Drains before opening in 2009.
With the majority of public pools in the Dallas and Fort Worth, Texas area planning to make the switch over to Anti-Vortex / Anti-Entrapment Drain covers in the Spring of 2009, American Leak Detection is offering installation services as soon as January 1, 2009. |
